According to the tipster, residents who live above the back garden had complained about incessant smoking from the bar's patrons...
How can I get similar relief from the backyard smoking lounge at Summit on Avenue C? Supposed to close at 11pm but they stay out there all hours with blazing lights and loud smoky drunks making a nuisance.
ReplyDeleteyou need to tell the CB about the problem. you can go to website www.cb3manhattan.org and fill out Make a complaint" form on right-hand side of home page.
ReplyDeleteHow do you know that they agreed to close by 11pm? Was it a stipulation for approval of their liquor license? I just tried to search 133 Ave C at the CB3 website but didn't come up with anything since 2007-Bazara which only said they have to stop serving minors.
ReplyDeleteIt is my understanding that all outdoor spaces at establishments that serve alcohol must be closed at 11pm? I may be wrong about that.
ReplyDeleteActually in rereading your comment, you are talking about a backyard lounge, not a sidewalk cafe. Backyards are unregulated (I believe).
ReplyDeleteBackyards are a huge problem to so many people because they often exist in a place where echos make it much louder than it would be in a different location.
One thing you can do is to make complaints to 311 about the noise, note your complaint number and submit it with a second complaint on the CB3 website (there are claims that 311 complaints are "lost" and this way there is another official record of your complaint). Ask your neighbors who are also bothered by the noise do the same so that you aren't the only complainer which then makes it seem like you are just cranky rather than a resident with a legitimate concern.
When their liquor license comes up for renewal it will get onto the Cb3 agenda as "renewal with complaint history) and then you can have the opportunity to get stipulations put into their license asking for them to close the backyard earlier.
If there are no complaints, renewals are not heard by the Community Board, they are just approved.
Theoretically the stipulations are then enforced by the police, if you can get the police to show up when you call, which I have heard doesn't happen too frequently. But at least then you can also have a conversation with the owner and ask them to abide by the requests of the Community Board.

Bull McCabes was closed because it was a fire safety hazzard. There were not proper egresses in case of fire. Not sure if this relates to people in building above that need egress or people in backyard.
ReplyDeleteThey were closed due to the complaint of a neighbor. If you don't want to live near a bar on St. Marks, then don't live near a bar on St. Marks.
