A Manhattan man alleges in court documents that he was bucked off a malfunctioning Citi Bike and busted his elbows.
Daniel Cole of Astor Place demanded in court papers filed Thursday in Manhattan Supreme Court that the bike he crashed on be immediately taken out of action and that all parts and bolts be preserved for his attorneys to inspect.
Cole, a married father, said he’s had to undergo surgery on both his elbows since getting thrown from one of the blue bikes on Broadway.
The legal action he took Thursday is a prelude to a lawsuit against the popular bike-sharing program, his attorney said.
The scare happened July 29, shortly after Cole check out bike No. 01563 from a docking station at Lafayette St. and E. 8th St. near his apartment.
As he was peddling on Broadway at 9:30 a.m., “all of a sudden the front tie ‘locked up’ and I was thrown from the bike and crashed,” Cole claims in the papers.
“After the fall I was able to observe that the front fender of the bike had become partially dislodged and was bent in half interfering with the operation of the front wheel,” Cole contends.
