Residents who live near the new Small Village Deli — which opened last weekend on the NW corner of Avenue B and Fifth Street — say they're already dealing with quality-of-life issues tied to the 24/7 operation.
For starters, issues existed even before the market opened. Neighbors questioned the ultra-bright signage. According to a Department of Buildings summons posted to the door last month: "Observed illuminated sign approx 80 sq feet above premises, no permit on file, creating a safety hazard."
The violation carries a $2,500 penalty.
Several neighbors have cited a new and loud exhaust system — described by one resident as sounding "like a jet engine" — along with persistent cooking odors entering nearby apartments. "I was lying in bed, awake before 6 a.m., enjoying the wonderful silence. And then the fan went on at 5:59 a.m.," said Kim-Nora, who lives across the street. "The exhaust system noise seems well above ambient street-level noise at this time of day. This should be the quietest time of day right now … but that thing just sounds like a big truck idling at high RPMs. Difficult to hear the birds now."

The space at 76 Avenue B has housed several businesses in the past 15 years — including restaurants (Oda House and Caffe Buon Gusto) and a deli (Zips) — though neighbors say the current setup is creating new issues.
Loyan Beausoleil, vice president of the 6 & B Garden next door, said she stopped in to raise concerns about the noise ahead of the garden's public reopening in April.
"I told them how the fan was very loud in the garden, explaining that we are their neighbors and are hopeful they would make sure it was quiet before we open," she said. "[The owner] was very rude to me and yelled that we were just going to have to get used to it, adding that he was not going to change it."
Beausoleil said she left without arguing, but noted that several nearby delis have built better relationships with the community. (The owner asked EVG to leave on a recent visit.)
"Once the garden is open, I will encourage visitors to avoid Small Village and choose the other delis that act like good neighbors," Beausoleil said.
Another longtime tenant in the building, who asked not to be named, said the fan ran overnight and was audible even with windows closed.
"Sounds like a big Mack truck idling right outside your window. And that's with all the windows closed — and the weather is about to warm up, and we want our windows open — and I want to hear the birdsong starting at 4 a.m.," the resident said. "It's literally a nightmare."
The tenant (and others) said they have contacted the landlord, spoken with the super and deli staff, and filed a 311 complaint, with plans to reach out to Community Board 3 and other local officials if the issue continues.
"Like I have time for this?" the resident added. "If it's killing my sleep, I guess so."





Figures they are assholes. I knew they would be obnoxious the second I saw the obnoxious level of light and signage on this space. How awful they are being rude to everyone in the process too. Sounds like a boycott and some signs outside are in the cards

ReplyDeleteI've had one of those fans outside my apt for 20 years. It shakes everything and drives me crazy. It seems to be a widespread problem for any business with a kitchen.
ReplyDeleteThe vent in the photo is an old one built by the restaurant Lavagna. That was a fight to get put in. This new deli has been quiet the last couple of days. Food kitchens are required to build expensive, quiet vents that go above the roof line to prevent ruining the quality of life for residents and parks. A convenience store like this would like to avoid paying for permits and equipment if they can get away with it.

ReplyDeleteBoycotting them. The proliferation of the super brightly lit delis much less onerous fans and chimneys around my apartment really impact quality of life and health too. Being surrounded by restaurants, I have numerous chimneys, reminding my apartment, and my apartment is covered with greasy soot and have bad asthma. Call 311 and file complaints anonymously. It’s easy to do And it is the only thing that makes a difference aside from calling our City Council rep’s office all the time.
ReplyDeleteThe fan is SO LOUD that you can hear it from 6th Street. It's impossible to be in the garden now, the noise is deafening and drowns out all peace and nature. One business composed of a few people should not be allowed to act like a dictator and ruin the peace and quality of life of 100+ gardeners, plus dozens of neighbors. If someone knows of a city agency that can act on this, please share in the comments here.

ReplyDelete"This should be the quietest time of day right now" - Come visit us on the corner of C & 10th at 6AM or earlier any given day. Delivery trucks idling on no stop anytime zone at all hours of the night, although they have a designated zone on 9th & C. Who needs 3 delis on just one street intersection and another 2 just one short block away?
ReplyDeleteNormally I roll my eyes at noise complaints in the neighborhood (because what do you expect?, but this is not what you’d call within reason. The neighbors should go full Kenny Rogers Roasters
ReplyDeleteMany years ago, 1990s, I had a dispute with a restaurant in the building next door building where. Both were old buildings over 100 years old tenements. Anyway... fan suddenly was very noisey and sometimes they did not turn it off after they closed for the night. They were so nasty, denying everything about the situation. I did a mediation community thing with them and they just lied about everything in front of the impartial mediator. I left that apartment, it was a coop, I sold it. I just could not take it anymore, it was bad for my health. Never to return to The Village. I just was not going to deal with these horrible people anymore. Even though it cost me, it saved my health.
