Rosie Mendez co-sponsors proposed new city legislation cracking down on Airbnb



Local City Council member Rosie Mendez is one of two sponsors behind new legislation that would potentially empower tenants to sue their landlords for using Airbnb or other short-term stay services to rent out neighboring apartments as hotel rooms.

Here's the official release via Mendez's office yesterday:

NYC Council Members Rory Lancman and Rosie Mendez announced the introduction of legislation to crack down on tenant harassment from illegal hotel conversions. Their bill would expand the definition of harassment to include illegal conversions of residential units, and create a new civil penalty for landlords who use Airbnb and other illegal hotel companies to harass and push out tenants using illegal conversions.

"Airbnb and illegal hotels destroy the quality of life of those around them and pose a grave threat to New York's affordable housing supply. This bill lets tenants take landlords to court to win injunctions against illegal conversions and impose fines that support the city's housing enforcement efforts. We need to call out illegal hotel conversions for what they really are — tenant harassment," said NYC Council Member Rory Lancman, Chair of the Committee on Courts & Legal Services.

“I am proud to co-introduce legislation with Councilman Rory Lancman that would enable tenants to sue their landlords in housing court for renting out residential apartments, contrary to the law, as hotel units,” said NYC Council Member Rosie Mendez.

Tenant harassment complaints in Housing Court have nearly doubled since 2011, and complaints of illegal hotels in New York City have also greatly increased in recent years. In 2014, there were 1,150 illegal hotel complaints, a 62 percent increase since 2013. 883 inspections were performed in response to those 1,150 complaints and 804 violations were issued. Unsurprisingly, the growth of illegal hotel activity in New York City has matched rapid growth of online short-term rental websites like Airbnb.

There are currently over 28,000 residential units being listed for transient hotel use on Airbnb. This represents a 5,800 percent growth in units from 2009, when Airbnb first began allowing New Yorkers to list their residences online. A report published late last year by the New York State Attorney General analyzing Airbnb bookings in New York City from January 1, 2010 through June 2, 2014, found that nearly 75 percent of Airbnb’s listings were in violation of state law.

Furthermore, a new data tool – www.insideairbnb.com — launched by an independent software developer that collects all public data points from Airbnb’s website showed:

• The value of 77 percent of Airbnb listings comes from illegal rentals of entire apartments;

• Nearly 60 percent (16,000) of Airbnb listings offer the entire home/apartment (in violation of state law), and those units are available for rent an average of 247 days (68 percent of the year); and

• Nearly one-third of Airbnb listings come from hosts with multiple units, such as commercial landlords, not regular New York tenants.

Currently, the definition of what constitutes legally actionable harassment does not include illegal conversions. If passed, this new expanded definition of harassment would allow a court to impose a civil penalty against a landlord of between $1,000 and $5,000 for every unit in which the court finds a tenant who is lawfully entitled to that unit has been harassed (through the existence of an illegal conversion).

Just last week, Governor Cuomo, Attorney General Schneiderman, and Mayor de Blasio announced the launch of a joint enforcement task force, titled the Tenant Harassment Prevention Task Force, to investigate and bring enforcement actions – including criminal charges – against landlords who harass tenants. The task force will confront the rise in complaints that landlords are using a variety of tactics, including disruptive and dangerous renovation and construction projects, to force tenants into vacating rent-regulated apartments.

Under the Lancman/Mendez tenant harassment bill, illegal hotel conversions would be included in the definition of harassment, and therefore could fall under the jurisdiction of the Tenant Harassment Prevention Task Force and be subject to its investigations and enforcement actions.

Airbnb spokeperson Nick Papas told the Post: "We strongly oppose large-scale illegal hotels and we know most Airbnb hosts share only the home in which they live and use the money they earn to pay the bills."

Local elected officials urge Mayor de Blasio to help return the former PS 64 to the community

A group of residents, community leaders and local elected officials delivered more than 1,000 holiday cards to City Hall yesterday afternoon urging Mayor de Blasio to help return the former PS 64 and CHARAS/El Bohio community center on East Ninth Street to the neighborhood.

The group delivered the greeting cards along with gold-wrapped chocolate coins, frankincense and myrrh on Three Kings Day to help draw attention to the ongoing battle for the landmarked building between Avenue B and Avenue C.



Developer Gregg Singer, who bought the building from the city in 1998, has to date unsuccessfully been able to convert the long-emtpy space into a dorm. There is currently a Stop Work Order on the site that the city issued in September.

Mendez: "The Former PS 64 CHARAS/El Bohio was a school building and a cultural community center that cultivated the hopes and dreams of so many people in our community. Community activists laid the seeds and the foundation that created our community gardens and our urban homesteading buildings while sitting in a room at CHARAS. This holiday season my community and I want nothing more than to get our building back."

Manhattan Borough President Gale A. Brewer: "Not too long ago, the CHARAS community center was an anchor that enriched this neighborhood, and with Mayor de Blasio's help it can be again. The Giuliani administration was wrong to shutter this community center and hand this historic space over to developers. The chance Mayor de Blasio has right now is one we rarely get: an opportunity to reclaim a lost jewel and make this neighborhood whole again."

Congresswoman Nydia Velazquez: "CHARAS was a cherished public space and I will continue to support my community in its efforts to reclaim the building for the
community!"

State Senator Brad Hoylman: "We have reached a critical point in the decades-long fight to reclaim the PS 64/CHARAS building for community use. However, we are still at risk of losing this valuable asset to unwanted and unnecessary development. I look forward to working with all stakeholders to help ensure that CHARAS truly benefits the neighborhood, instead of private interests."

As for the Mayor, he happened to arrive halfway through the event, but walked right by and into City Hall without acknowledging the group.



Per previous reports, both The Joffrey Ballet School and Cooper Union have signed on to place its students at what will be called University House.



On Monday, Singer told DNAinfo's Lisha Arino that "the city issued the order because it wanted to clarify the language in the leases" he signed with the schools. He said that he is "working with the city to change the wording and hopes to restart construction by the end of next month."

Singer also said that he wasn't opposed to the idea of a community center in part of the space, though he hadn't seen any proposals for a community center. One local leader disputed this, telling DNAinfo that Singer "has never reached out to us in good intention and good faith."

At the rally for PS 64 Sunday

On Sunday afternoon, nearly 200 residents along with a handful of elected officials gathered on East Ninth Street to discuss the future of the former PS 64 and CHARAS/El Bohio community center.

As reported last week, the Department of Buildings has put a stop, for now, to developer Gregg Singer's plans to convert the long-emtpy building between Avenue B and Avenue C into a dorm.

The DOB had approved Singer's application to have tenant Joffrey Ballet considered a not-for-profit with housing accommodations as opposed to a dormitory. However, Joffrey is not a nonprofit, meaning the lease did not meet the DOB's requirements for educational institutions.

Some residents want to see the building returned to community use.

Said Manhattan Borough President Gale Brewer at the rally: "Every neighborhood needs a strong, vibrant community center. Every neighborhood does not need a dorm. If we don't have the art and culture that this community is known for, we do not have our mental health."

Reminders: PS 64 press conference tomorrow



As noted on Wednesday, the Department of Buildings has put a stop to developer Gregg Singer's plans to convert the former PS 64 and CHARAS/El Bohio community center on East Ninth Street into a dorm.

The DOB had approved Singer's application to have tenant Joffrey Ballet considered a not-for-profit with housing accommodations as opposed to a dormitory. However, Joffrey is not a nonprofit, meaning the lease did not meet the DOB's requirements for educational institutions.

Councilmember Rosie Mendez and other local elected officials will discuss this latest development during the press conference.

Rosie Mendez wins the Democratic primary for District 2 City Council

A quick note from yesterday's primary election... in the race for District 2 City Council, which includes the East Village, part of the Lower East Side and Union Square, among other neighborhoods, two-term Councilmember Rosie Mendez defeated Pastor Richard Del Rio 81 percent to 18 percent. The Lo-Down has more details on other local races of interest.

Developer Gregg Singer, who purchased old P.S. 64, formerly CHARAS / El Bohio Community & Cultural Center at 605 East 9th Street, at public auction in 1999, has once again filed plans to convert our former school and community center into a 500 bed dormitory & youth hostel. In plans filed recently with the Landmarks Preservation Commission and the Department of Buildings, Singer claims to have a signed lease with Cooper Union for 200 of the proposed 500 bed facility, though no lease has been submitted. In addition, Singer must submit proof that all beds have been leased by an educational institution for a ten-year period.

It is time to ask the City to return the building to the community!

Landmarks Preservation Commission asks to see modified plans for former PS 64

The Landmarks Preservation Commission (LPC) heard public comments yesterday regarding the former PS 64 and CHARAS/El Bohio community center on East Ninth Street. Developer Gregg Singer will need approvals from the LPC in order to make changes to the exterior of the landmarked building for his proposed 500-bed dormitory. (Those changes include adding a raised courtyard space.)

Several people testified against the proposal, including City Councilmember Rosie Mendez and representatives from the Greenwich Village Society for Historic Preservation and the East Village Community Coalition, who want a better plan for the space — one that serves the community.

One person in attendance said that the commissioners responded positively to the architect's plans for renovation. The commissioners did not vote on the proposal and made suggestions to the applicant to modify the plans... the next step will be a public meeting where the amended plans will be presented. (The public can attend this next meeting, but not speak for or against the plans. Date to be determined.)

The former PS 64 is also on the agenda for tonight's CB3 Land Use, Zoning, Public & Private Housing Committee meeting, which is at 6:30 — Seward Park Extension, 56 Essex St. (between Grand and Broome Streets).

Testimony Of Councilmember Rosie Mendez regarding the former PS 64



This afternoon, the Landmarks Preservation Commission is listening to public comment regarding the former PS 64 and CHARAS/El Bohio community center on East Ninth Street... developer Gregg Singer will need approvals from the LPC to make changes to the exterior of the building for his proposed 500-bed dormitory. What follows is the testimony given by Councilmember Rosie Mendez...

Good afternoon, my name is Rosie Mendez — and I am the City Council Member who proudly represents District 2 — including the entirety of 605 East 9th Street which is the subject matter of this Public Hearing on application 14-2418 concerning the appropriateness of proposed alternations at the underlying site. Thank you for allowing me the opportunity to testify here today on this most important matter.

In 2006, after years of concentrated community effort, the LPC designated the old PS 64/CHARAS El Bohio Cultural and Community Center as an Individual Landmark, citing many
singular facets of its design and century-long role as a publicly accessible community resource. In fact, the beautifully written designation report narrates at length about the rare architectural and community significance of this beloved building. I would go a step further and call the CHARAS building an absolute community treasure that universally symbolizes our shared history, collective struggles and our united path forward.

While the LPC is not specifically empowered to consider use — the history, architecture, cultural and community significance of this building is inexorably intertwined with the role it has played in the lives of successive generations on the Lower East Side. This building embodies a unique composition of remarkable and unequaled architectural features paired with a longstanding community-driven mission that dates back to 1904. Today, I urge the LPC to protect both of the unparalleled features of this building.

With respect to the plans submitted by the applicant, I have very serious concerns about the alterations proposed to the exterior of the building. My specific concerns include, without limitation:

• The proposed work on the roof — including installation of metal screen railings, mechanical equipment, an ATS room, boiler room and four stair bulkheads — will substantially detract from the distinctive roofline profile of the CHARAS building. These alterations may very well compromise the remarkable and striking architectural features of the building — including the mansard roof and pedimented dormer windows that are specifically cited — for their uniqueness and distinction — in the designation report. These dormers are, of course, the very same that were systematically destroyed, removed, and relocated in 2006, leaving nothing but a tarp flapping in the wind for the last seven years.

• I am very concerned that the proposed removal work in the elevated courtyards will undermine the hallmark concept and original design of this unique H-Plan building. The elimination and privatization of floor space on the 9th Street side of the building stands in stark contrast to the preserved vision, as articulated in the designation report which states, “The open space provided by the courtyards, the large groups of windows and the elegant decorative ornament were generous gestures and made this building stand out in this neighborhood of plain, rundown, and overcrowded tenements”... as these courtyards provided… “the luxury of open space in densely packed neighborhoods.”

Many things have changed since 1904, but the need for shared open space that is a source of community pride has not.

Conclusively, I strongly recommend that the LPC refrain from approving this proposal and require the developer to amend the current plans in a manner that entirely preserves the exclusive and remarkable characteristics of the CHARAS building — including the distinctive and landmarked roof, dormers and courtyards — consistent with the original design and designation report.



At this hearing, the LPC will officially vote to approve or deny the application... the Commission may also ask the applicant to return to a future hearing with revisions. We'll keep you posted as to what transpired this afternoon...

Rosie Mendez leads call on NYCHA officials to improve infill development process

Friday at 9 a.m. on the steps of City Hall, City Councilwoman Rosie Mendez, Chair of the Committee on Public Housing, and Council Members Margaret Chin and Melissa Mark-Viverito will be joined by other elected officials, Tenant Association Presidents, community organizations, advocates and concerned residents as they hold a press conference to demand that the New York City Housing Authority (NYCHA) improve the Infill Development process to empower residents.

The Council Members will then proceed to Council Chambers in City Hall to conduct an oversight hearing of NYCHA’s Infill Development/land lease proposal and to consider a resolution that calls on NYCHA to “engage its residents in planning for and to include certain requirements in any ground leases for NYCHA land.”

In addition to the provisions in the resolution, the Council members will call on NYCHA to hold themselves to a “gold standard” of resident and community engagement, including, without limitation:

• Additional time between Infill meetings at affected developments so that all affected Tenant Associations and residents can secure independent legal and technical assistance to review plans and make meaningful comments

• Additional time between now and the release of the RFP — including a third meeting where residents and their “technical advisory team” can review a draft RFP and comment upon it before it is released

• NYCHA must ensure that all comments on the Infill plans are addressed and responded to; they must also provide a paper based system (to compliment the online portal) that captures the comments of those who do not have internet access. Lastly, suggestions should be centrally posted and logged for all residents to review

• NYCHA should commit to full Uniform Land Use Review Procedure (ULURP) review for each Infill site, ensuring that the community has an effective voice in the process and that additional considerations and interconnected issues that major development presents are unilaterally addressed

Report: Mendez office to crack down on crusties

In his current column in The Villager, Scoopy reports that City Councilmember Rosie Mendez is planning to crack down on the crusties. A report that Mendez's office recently issued to Community Board 2 last week said that she is aware of the complaints about the seasonal transient population, and is working with outreach teams to help get them off the street.

Per the report, as quoted by Scoopy: "The challenge in removing them is that people have the right to refuse services and to live in the street. Rosie is researching the laws that protect such transients with the intent of tightening up loopholes, so that in the future, these individuals will not have the opportunity to take over the sidewalks in the East Village and Lower East Side and thereby reduce the quality of life of residents."

We asked Mendez's copy of the report, but did not receive any response.

Meeting set to discuss bars and noise on Avenue A



Specifically on Avenue A between 12th Street and 14th Street, where two new bars have opened this summer to enthusiastic crowds.

According to the information that I received:

The meeting will be Wednesday, Aug. 12 at 6:30 p.m.

It will be at the Dias Y Flores Garden at 520-522 E. 13th St. (between A and B).

District 2 City Council member Rosie Mendez will run the meeting along with Susan Stetzer, district manager of Community Board 3. They will address the overabundance of bars and the noise they cause, what can be done by residents and what is being done and will be done by Mendez's office and CB3.
