.....but things are STILL NOT RIGHT about this program, its practitioners, AND its enablers.
Its great to see ultraliberals so anti fourth amendment when their guy does it. Bravo.

ReplyDeleteHey Shawn - I seem to recall you are pretty tech. savvy, but maybe not. The fact that the media most likely did get it "wrong" in the manner described in that article (and by manner "talking heads" recently) is a VERY deceptive and very misleading argument.
ReplyDeleteThe powers that be most likely DO NOT WANT direct access to the servers of facebook, et. al. What they would want is a tailor-made "cleaned up" version specific to their needs.
This makes both fb and the powers-that-be happy, 'cause the data is accessible AND the powers that be won't accidentally f up the servers at fb, et al.
Then Zuckerberg can say emphatically "the media reports that the feds have direct access to our servers is 100% false" or whatever it was he said. And he is correct. But he is purposely misleading... and it sort of depends on "what is is", you know?
The fact that they as sucking up all the data without a warrant is stunning. And if you are a tea party member (given the current administration) or a La Raza member (given the next) you should be worried about IRS style abuse of the system.
If they don't have the power, they can't abuse it.
Right President Obama has absolutely no control over the intelligence agencies....or the treasury agencies.....or any other executive level agencies....or his wife......or anything else. But the's the best President ever!!!!

Section 702, Foreign Intelligence Surveillance Act
[The N.S.A.] (1) may not intentionally target any person known at the time of acquisition to be located in the United States; (2) may not intentionally target a person reasonably believed to be located outside the United States if the purpose of such acquisition is to target a particular, known person reasonably believed to be in the United States; (3) may not intentionally target a United States person reasonably believed to be located outside the United States; (4) may not intentionally acquire any communication as to which the sender and all intended recipients are known at the time of the acquisition to be located in the United States; and (5) shall be conducted in a manner consistent with the fourth amendment to the Constitution of the United States.
Hmmm. Sounds, uh, pretty OK to me.
Also, the NSA goes through a process called "minimizing."
It essentially means “stay out of American citizen’s business.” If information about specific Americans (or even foreigners inside the United States) is captured, those details must be removed from all records and cannot be shared with any other entity in the government unless it is necessary to understand and interpret related foreign intelligence or to protect lives from criminal threats.
As for access to servers: NOPE. I know for a fact that Google FTPs the raw data to the NSA and they have to freaking parse and comb through that data. It's not like they say "Here's Shawn's Gmail password, have fun!"
But really people. Look at that NSA Powerpoint. They're using Microsoft Office '97. Are you really that worried?

ReplyDeleteSo Google ftps data to the NSA. Then Google and Zuckerberg can honestly say "they do NOT have access to our servers" - while still provided the Feds all the data. Nice.
ReplyDeleteThere is a huge difference between the NSA calling up googlefacebook and saying "give us info on this IP address".. and have access to ALL the data. The first version is much harder to abuse. The 2nd is easy to abuse.
We've seen the IRS abuse their targeting capabilities. If they didn't have the power/access they couldn't do it. The same goes for the NSA. That is why this is news and important.
The IRS certain violated freedom of expression. This data sucking program increases their capability to do so.
Sure, FISA says it's illegal. But why not keep it from being possible by disallowing the capability in the first place? The NSA can still investigate whatever IP addresses and emails they want to, WITHOUT having data on all Americans.

Now it turns out the NSA has unfettered authority to actually LISTEN to our phone calls, read our emails and texts, without a warrabt and has been doing same. Google it and lay off the michael moore filmfestivals.
