[Updated] Someone is playing really loud music along Second Avenue (again)

Updated a few things from the previous version...

Oh, back in October 2012, there were published reports about The Virgins practicing in frontman Donald Cumming's apartment on Second Avenue between St. Mark's Place and East Seventh Street. Some people didn't care for the noise.

Per DNAinfo:

"I think they are so full of themselves they keep their window open," said the resident, who declined to provide her name, at a meeting of the Ninth Precinct Community Council.

And that was that.

The band officially broke up back in November.

Now the noise complaints from the building are back ... with a band playing (previewing Cumming's upcoming solo record?), practicing (whatever!) with the windows open again ... and some neighbors aren't happy, as we've heard.

One resident said that the band started playing last night around 10:30-11 ... and continued until near 2 a.m. Ditto for Sunday evening. They didn't play for as long on Monday night — until 11 or so.

"They are so absurdly loud ... and it's really disruptive to those of us in the East Village who work 9-5 (more like 8-7) jobs," one neighbor told us today. "It's hard to sleep when the music is playing so loud."

Solutions?

"I've called 311 and the 9th precinct; 311 doesn't ever get back to me, and the 9th Precinct has hung up on my phone calls at least seven times," the resident said. "I appreciate that they're part of what makes this neighborhood great, but it's really impacting my sleep schedule — and that of my neighbor's — in a negative way."

  2. Are you kidding? If I can't get an exhaust motor with measured pollution of 54 db in my apt running 13 hours a day 7 days a week shut down, the city ain't gonna do shit about some intermitent band playing in a rent stabilized building. Was there any resolution with that 7/11 motor placed right next to residents windows you guys wrote about last year? Your best chance is to call in gunshots from a payphone, and make sure no cameras are around.

  4. Aren't they all fancy-pants rich boys, a la the Strokes? Not to say rich boys can't make good music (sometimes). But they are typically godawful neighbors.

  5. nygrump, we're still fighting the 7-Eleven refrigeration and a/c units outside our windows. The DEP has issued a second noise violation. In two months we can request another reading and when the third violation is issued, Westminster will be required to either move the units or shut them down. In regards to our complaints, I must write, the DEP IS helping. Your complaint may also fall into their jurisdiction (?). Good luck. We may be psychologically tortured by the droning, clanging, shuddering, whooshing, and grinding, but your issue is a heck of a lot more physically damaging.

  7. get the tenants organized.
    don't pay the rent.
    send a letter to the landlord about this breach of the warranty of habitability.
    try calling a tenant assistance group (dare i suggest your councilperson?) or dhcr, and then if necessary call a tenant attorney
    and while you're at it send a copy of your letter to the landlord to everyone you can think of for the record (including cb#3, you can document inaction by the "authorities".
    and maybe have a press conference
    noise is so hard to get action on - this neighborhood has become one big loud party!

    1. You might be interested, or not, to know that shut like this didn't happen around here 20, 30 years ago. Hard to believe, but true. That was before rich deathly assholes lived here. Those are the ones who need to move back to the sticks. Not the people who'be been here since before you were born.

    2. You really have no idea who lives here outside of the newbies, do you? Kind of pathetic. Even in the bad old days, people practiced at a rehersal studio or somewhere deserted. At the very least, during the day, but people weren't such assholes then and on such a regular basis. And there were blissfully fewer people around here. The jerks were uptown. Eh. So it goes.

  12. Brian P. Katz, keep us updated on this, I hope you guys get some resolution. Spice Cove has changed their hours, to 5 pm to 2 am now to get the early cokehead crowd, so the noise and vibration pollution goes late. We've tried organizing but many are foreign nationals and don't want to rock any boat. Another part of the "All Transient All the Time" Bloomberg days...

  13. they should practice before sleeping hours, that said, in my 20's and 30's I was part of the band playing all night crowd. But this is now, and these adorable boys should move to Red Hook or somewhere where annoying transplants from the suburbs don't have to get up for work. Neighbors, get earplugs until they get the 5 day notice and seriously, relax, you live in a neighborhood where many musicians started. Be happy you don't have to run home from the subway and step over doped up junkies.

  14. 9:51, not one of these dudes is super good-looking in my opinion and it will only get worse as they age. Although I sadly agree that adorable rock n' roll types should mostly be allowed to do as they please, this is not Duran Duran we're talking about (LOL). These guys look like unwashed, overprivileged dinks. Nice headband.
