Community Board 3 has now received complaints from residents from April of 2014 through July of 2015, about the failure of the business to oversee the sidewalk, unruly drunk patrons from the business blocking the sidewalk, excessive noise from patrons and music emanating from the sidewalk café, which has an open façade, all you can drink brunch specials, the sidewalk café operating past its permitted time of 10:00 P.M., the service of alcohol at the sidewalk café after its permitted closing time and the café taking up too much of the sidewalk;

...and, in May of 2015, the Department of Consumer Affairs issued two (2) violations against this business for its sidewalk café exceeding its permitted footprint on the sidewalk and having ten (10) too many tables when it was permitted for ten (10) tables and twenty (20) seats with a closing time of 10:00 P.M. every day; and, this business has received eight (8) 311 commercial noise complaints between April 13, 2014 and June 25, 2015, between 3:30 P.M. and 1:00 A.M., six (6) of which resulted in police reporting that they took action to correct a nonprime ...

Poco's website advertises that they are "NYC's favorite boozy brunch."

Team behind Shoolbred's and Ninth Ward vying for 10 Degrees Bistro space on Avenue A

Nic Ratner and Robert Morgan, owners of three establishments on Second Avenue — Shoolbred's, Ninth Ward and Kingston Hall — look to be expanding their reach to Avenue A.

According to public documents (PDF!) on file at the CB3 website, Ratner and Morgan are applying for a new liquor license for the former 10 Degrees Bistro and Flea Market Cafe space at 131 Avenue A.

There aren't many details, such as a proposed name and menu served, on the questionnaire filed ahead of Monday night's CB3 SLA committee meeting. The paperwork shows 8 tables good for 31 seats as well as an L-shaped, 15-foot bar. The proposed hours are Sunday-Thursday 1 p.m. to 2 a.m.; until 4 a.m. on Friday and Saturday.

As we first reported on Aug. 18, the landlord took legal possession of the restaurant between St. Mark's Place and East Ninth Street. A sign arrived the next day noting that 10 Degrees was closed for maintenance. They never reopened.

The proprietors of Ten Degrees Bar, which remains open around the corner on St. Mark's Place, took over operations of the Flea Market Cafe in March 2013 ... changing the name to 10 Degrees Bistro in December 2013.

The December CB3-SLA committee meeting is Monday night at 6:30 in the CB3 office, 59 E. Fourth St. between Second Avenue and the Bowery.

Report: CB3 committee opposes de Blasio's proposed rezoning plans

CB3 is the latest Community Board to voice opposition to Mayor de Blasio's citywide housing proposals.

As DNAinfo reports, CB3's Land Use, Zoning, Public and Private Housing Committee drafted two resolutions against the city's Zoning for Quality and Affordability and Mandatory Inclusionary Housing amendments last night.

CB3 will formally take a position on the proposed text amendments on Tuesday night (6:30) at its full board meeting at P.S. 20 Anna Silver School, 166 Essex St.

The Post reported that, as of Monday, at least 22 of the city’s 59 community boards have voted against de Blasio's affordable-housing zoning plan.

Here's a summation of the plans via Capital New York:

The first of the two proposals would require that developers who build in an area rezoned by the city reserve 25 or 30 percent of their apartments in any given project for below-market rents. The second would allow an additional five feet be added to buildings in certain areas (as long as that extra height does not create a penthouse), would limit required parking for affordable housing in some places, and enable parking lots attached to affordable senior housing developments to be torn down to make way for more residential units (based on the notion that senior citizens are less likely to drive).

When asked for reaction about the Community Board opposition this week, de Blasio said, as reported by Capital New York:

"I am never surprised when a community board raises concerns and particularly local concerns. But we're going to keep moving full speed ahead to make these reforms, because we must create a vast amount of more affordable housing. We must preserve a huge amount affordable housing or else people will not be able to live in this city. It's as simple as that."

The plan requires advisory input from Community Boards and borough presidents as well as approval from the City Council.

On the CB3-SLA docket: A new applicant for the former Bodhi Tree space; a scratch for NatureEs

Last month, the folks behind Shorty’s Authentic Philly Steaks & Sandwiches had designs on opening their fifth NYC location at 58 Third Ave. between East 10th Street and East 11th Street.

However, Team Shorty's withdrew their proposal ahead of the October CB3-SLA committee meeting. Now, there's a new applicant for the space, which, until July, housed the Thai restaurant Bodhi Tree.

There aren't many details on the application (PDF!) filed ahead of this month's CB3-SLA committee meeting on Nov. 16. The restaurant is going by the name of Mulan East with posted hours of 11:30 a.m. to 11 p.m. Sunday through Thursday; until 11:30 p.m. on Friday and Saturday.

The configuration shows 17 tables good for 46 seats and well as a service bar with four seats. According to the paperwork, the two principals, listed as Ling Xia He and Yung Ping Wong, have not previously held a liquor license. They are seeking a beer-wine license for this space.

In other applicant news this month, the plan to convert the now-closed NatureEs juice bar/wellness center on East First Street into a Spanish bistro appears to be on hold. The applicants have withdrawn from the November CB3-SLA meeting.

Wine, brandy and French-Mediterranean cuisine in the works for the former Luca Bar

The former Luca Bar space at 119 St. Mark's Place between Avenue A and First Avenue hit the market in the early summer.

And there's a taker for the space. Reps for Le Delice are on tomorrow night's CB3/SLA committee meeting docket for a new liquor license. The bar-restaurant will serve French-Mediterranean cuisine, according to the PDF on file at the CB3 website.

The notice on the front door refers to Le Delice as a "wine and brandy establishment."



The application shows a configuration with 10 tables good for 24 seats and a bar with 15 stools. The proposed hours are 5 p.m. to midnight Monday-Wedneday; until 1 a.m. Thursday-Saturday… and there are opening hours of 11 a.m. on the weekend for a likely brunch service.

The SLA meeting is at the CB3 office, 59 E. Fourth St. between Second Avenue and the Bowery.

Something new in the works for 25 Avenue B

After just two months at 25 Avenue B, Matty's shut down back in February. There's now a new applicant for the bar space between East Second Street and East Third Street.

According to the questionnaire (the PDF is here) on file ahead of the September CB3/SLA committee meeting, there's is a 100 percent corporate change for the business... and a name change to Avenida Cantina.



However, despite a new concept and partners, this item will not be heard in front of the committee. There isn't any other information at the moment about what to expect from the new venture.

In the past few years, 25 Avenue B was home to Idle Hands and Station B and Billy Hurricane's.

A listing for the bi-level club shows an asking price of $299,000 with a monthly rent listed as $16,882.63.

Nicoletta looking to upgrade to a full liquor license on 2nd Avenue

Last evening, CB3 released the September agenda for the SLA committee meeting coming up on Sept. 1.

So far, not all the applications and questionnaires have been filed online. So we'll take a look in the days ahead as more information becomes available. (You can find the applicants here.)

One item to start with... Nicoletta, chef Michael White's Midwestern-style pizzeria that opened to a lot of hype in June 2012 (and lousy reviews), is on the docket for an upgrade to a full liquor license. (They currently only serve beer and wine.)

There was speculation almost two years ago to the day that White might close Nicoletta and swap it out for another restaurant from his empire. (Eater even put the pizzeria on Second Avenue and East 10th Street on Deathwatch.)

Well, two years later, and Nicoletta has expanded into New Jersey with a space in D.C. on the way. Anyway, they'll likely be more speculation as to whether Nicoletta will solider on with full liquor, or if this is a step to secure a license for another venture.

And it has been about two years since we heard anything from anyone about the place. Early on, some EVG readers were turned off by Nicoletta's T.G.I. Fridaysish interior and clipboard-toting hostesses standing guard by the door. Feeling any different about Nicoletta these days?

Tompkins Square Park will be a little less shady

Earlier today, the Community Board 3 office passed along some information from the Parks Department, who recently completed an assessment of trees in city parks throughout Manhattan.

Crews have identified some trees that are dead, decaying or structurally unsound, and need to be removed for public safety. Unfortunately, according to the Parks Department, six of those trees reside in Tompkins Square Park.

EVG correspondent Steven was in the Park this afternoon, and spotted a crew in charge of removing three trees on the East 10th Street side of the Park... one of which was pushing into a light pole...





CB3 District Manager Susan Stetzer said that complaints regarding unsafe trees have increased recently ... and that the Community Board is relaying those concerns in a timely manner to the Parks Department.

Stetzer also said that all six trees that the city removes will be replaced with new trees.

Casual French-American cafe in the works for 110 St. Mark's Place

Paprika, which specialized in Northern Italian cuisine, quietly closed back in the spring at 110 St. Mark's Place between Avenue A and First Avenue.

Applicants who plan on opening a casual French-American cafe will appear before CB3's SLA committee on Monday. They are seeking a beer-wine license…



The applicants include Hamid Rashidzada of the Summit Bar on Avenue C and most recently Bara on First Avenue, and chef David Malbequi, who worked for Daniel Boulud, according to paperwork (PDF!) on file ahead of the meeting at the CB3 website.

The still-unnamed cafe will serve American-French comfort food with daily lunch service from 11 a.m. to 4 p.m. The configuration shows 14 tables seating 58 people and a bar with 4-6 seats.

The July SLA committee meeting is Monday at the CB3 office, 59 E. Fourth St. between Second Avenue and the Bowery.

[Updated] Incoming restaurant on Avenue A asking residents to rally for their liquor license and back patio

Here's more information about the new Vietnamese restaurant in the works for 171 Avenue A between East 10th Street and East 11th Street.

The principals, siblings Stephan and Kimxuan Brezinsky who grew up in Stuy Town, will appear before CB3's SLA committee on Monday evening.

According to public information (PDF!) posted at CB3's website, the restaurant will be called Soothsayer, with proposed hours of 5:30 p.m.-midnight, Monday-Thursday; until 1 a.m. on Friday. They will also open at noon on Saturday and Sunday.

Stephan Brezinsky currently serves as bar manager at The Third Man on Avenue C, and previously served as general manager of Rue B on Avenue B, per the paperwork.

Soothsayer is requesting a full liquor license with use of the backyard garden. There are signs up at 171 Avenue A asking residents to "join us as we rally for our liquor license and for the approval to open a cozy back patio."



The sign also notes that they will offer "friendly and affordable dining experiences."

The previous tenant here, B.A.D. Burger, closed earlier this year. B.A.D. Burger was never able to secure a beer-wine license for the space. After CB3 denied his beer-wine request in 2012, B.A.D. Burger owner Keith Masco reportedly called the board "fascist."

Soothsayer withdrew its bid for 171 Avenue. It was much ado about the rear yard space, and the applicants’ inability to negotiate with the nearby block associations. Full liquor was sought, yet CB3 advised the team to return next month with a revamped application for beer-wine.

New projects in the works for the Tink's and B.A.D Burger spaces

CB3 should be releasing the agenda for July's SLA committee meeting some time soon... ahead of that, we have an idea of at least two applicants taking over now-closed spaces in the neighborhood...

CB3 shows support for a Community Gardens District; now will City Council do the same?

If gardeners have their way, Community Board 3 (CB3) will soon be the recipient of a Community Gardens District that will include all 46 remaining community gardens located within its boundaries; a plan spearheaded by the Coalition to Establish a Community Gardens District. They aren’t talking about the manicured version associated with the New Orleans Garden District but, rather, the home grown, gritty version we all know and love that’s particular to everything East Village and Lower East Side!

On Thursday night, CB3 voted overwhelmingly in favor of establishing of this plan with a vote of 28 to 1.

The Coalition says community gardens have a deep rooted history in CB3 and the distinction of having the very first one in the City started in CB3 by resident and visionary environmentalist, Liz Christy, in 1973. Christy’s name is legendary in the national and international greening movement. She reclaimed and repurposed hundreds of vacant lots through her leadership and work with the Green Guerillas, which she co-founded and is the City’s oldest gardening organization, and the City’s Council on the Enviornment, which she founded and headed and is now known and branded as Grow NYC.

Once there were over 60 community gardeners in Community Board 3 but only 46 remain. Of those owned by the City, the Coalition says none are permanent or receive dedicated budgets to address infrastructure needs. Gardeners and their growing list of supporters, want CB3’s community gardens mapped and designated as park land — which would then take an act of the state legislature to be used for any other purpose; designated as a special district to acknowledge their unique and well-earned place in the City’s history; and management left in the hands of community based volunteers which has proven to be a successful model of operation for over 40 years.

The District plan will next go before City Council. You may still show your support for preserving community gardens by signing this petition.

A bar called Matty's in the works for Idle Hands on Avenue B

Idle Hands looks to be changing ownership.

The bar at 25 Avenue B near East Second Street is on this month's CB3/SLA committee docket.

According to the paperwork (PDF!) on file at the CB3 website, Idle Hands is scheduled for a corporate change… as you can see, seven partners (essentially everyone) are leaving the corporation, and three new ones are joining…



The new venture will be Matty's, whose owners ran a gay bar in Ft. Lauderdale, Fla., called Matty's on the Drive.

Here's how the New Times Broward-Palm Beach described Matty's on the Drive:

Matty's closed in late 2012 following a year-long legal case.

There's no word yet on what kind of bar Matty's will be on Avenue B.

In October, Allan Mannarelli, an owner of The Cock, decided to withdraw his application for moving his bar from Second Avenue to the Idle Hands space when it became clear that the CB3/SLA committee was going to issue a denial.

The CB3/SLA committee meeting is Monday night at 6:30 in the CB3 offices, 59 E. Fourth St. between Second Avenue and the Bowery.

However, according to the docket, this item will NOT be heard during the meeting. Strange, given that the space will be under new ownership, yet the corporate name remains the same.

November CB3/SLA highlights: The return of Lucky Cheng's

Reader report: The Cock won't be moving into Idle Hands

As previously noted, The Cock was looking to move from Second Avenue to 25 Avenue B, into the current home of Idle Hands.

This item went before CB3's SLA committee on Monday night.

Several EVG readers in attendance noted that Allan Mannarelli, an owner of The Cock, decided to withdraw the application when it became clear that the committee was going to issue a denial. Several residents apparently spoke out against the application, including members of the East 4th Street A/B Block Association.
