The thing is, as best I (not a hawk expert) know, the hawk can not do anything at all to the squirrel when it is right next to it like this. The hawk relies on its dive to kill prey; it is not equipped to just lean over and slash the squirrel with its bill or gouge it with its talons. And squirrels know this.

The 2018 Mr. Squirrel-Hawk Agreement remains controversial.
Mr Squirrel agreed to notify the hawks where disgusting pigeons lurk in return the hawks leave Mr Squirrel alone.
And there is the Agreement where the black squirrels are not allowed below 14th Street.
