CB3/SLA committee March highlights: A new applicant for El Sombrero on Stanton Street?

CB3 released the SLA licensing committee docket on Wednesday… the agenda includes a new proposal for El Sombrero on Stanton and Ludlow, which was previously going to become another outpost of Artichoke Pizza. That deal fell through, as BoweryBoogie first reported last month.

Now, an entity named Two Almontes Corp. is aiming to take over the inexpensive Mexican restaurant that opened here in 1984. We asked Regina Bartkoff, who has worked here since 1988, about all this. She has been out of work the last few weeks with a wrist injury. However! "I heard this rumor and called the restaurant and they told me no! Nothing is happening."

So perhaps chalk this up to some pre-mature paperwork. Anyway, The Hat remains open, of course — go while you still can!

Meanwhile, the rest of the docket is pretty quiet in the way of Big Ticket items…

There have been a few potential suitors, though nothing ever came of the various proposals for the bar space. We spotted nine different for rent/sale signs on the business last summer ... The whole building remains on the market for $12 million.

CB3/SLA January highlights include new projects from Alex Stupak and John McDonald; plus a new applicant for 50 Avenue B

Community Board 3 has released its meeting schedule for the month… here's a look at the SLA Licensing Committee docket…

But first! The meeting is Jan. 13 at 6:30 p.m. … at the CB3 office, 59 E. Fourth St. between Second Avenue and the Bowery…

To date, not much is known about some of these applicants … so we'll just have to randomly speculate! (Like usual!) Anyway, to some East Village-related highlights from the agenda…

Empellón chef Alex Stupak plans to open his third restaurant at this location. The Sushi Lounge closed at the end of October.

Paperwork on file at the CB3 website lists the applicant as Mario Yagubi, owner of a boxing promotional group, as well as 1849 Restaurant, Bar and Parlor on Bleecker Street.

Here's more of the November CB3/SLA docket

Yesterday we looked at three of the applicants on the November CB3/SLA agenda. (Find that post here.)

And please note that the CB3/SLA meetings are now double the fun, double the drama! The meetings are now spread out over two nights.

CB3/SLA highlights: Liquor license applicants for former bakery, pet shop and hardware store

Community Board 3 released the agenda for next month's liquor licensing committee meeting... which is split over two nights — Nov. 18 and 19.

We'll take a look at the whole rundown later... until then, three items of interest ... three new liquor licenses for addresses that were previously not bars/restaurants ... for the time being, not much is known about the applicants...

New Liquor License Applications
• DY Schnitz LLC, 177 1st Ave (wb)

There's an applicant looking to take over the former Something Sweet space, the family-owned bakery at East 11th Street.

• Gaia Lounge (Sams 1 Lounge Inc), 103 E 2nd St (wb)

And there's an applicant eyeing the former family-run pet store on East Second Street between First Avenue and Avenue A. They closed in August 2012.

Plans for Brownstone Lounge and Grill on hold for now on Avenue B; Ludlow St. replacements go 0-3

A quick note about Monday evening's CB3/SLA committee meeting. Members of the East 4th St. Block Association and other nearby residents had concerns about the applicant looking to take over the former Affaire space at 50 Avenue B (aka (240 E. Fourth St.).

Among other concerns, the applicant for the Brownstone Lounge and Grill apparently doesn't have any restaurant experience ... with a business plan that relies upon private party rentals of the basement.

As we understand it, in lieu of a likely denial recommendation to the SLA from CB3/SLA committee, the Brownstone principal withdrew his application (for now), and was told that he was welcome to come back with more robust plans for a restaurant.

BoweryBoogie reported that the principal is an IT business manager in Harlem and none of the investors have any track record in the nightlife/restaurant industry. Given the nightlife fuckery around here through the years (LeSouk and China 1, for starters), residents were understandably concerned about about any potentially noisy operation here.

Meanwhile! One other note... the applicants looking to take over three Ludlow Street mainstays didn't fare so well.

• Chicken-and-waffles restaurant Sweet Chick was looking to open a second outpost in the Max Fish space. As BoweryBoogie reported: "Residents of the 100-year-old tenement were ultimately worried that a fried food establishment in a 'porous' building would negatively impact quality of life." The committee ultimately did not approve this application.

• The committee reportedly convinced the applicant looking to take over the former Motor City space to temporarily withdraw his application. The Lo-Down described the new concept as a restaurant "featuring skewers from around the world." Oh boy.

• The committee also denied Artichoke's bid to take over El Sombrero's space, via The Lo-Down.

An updated look at tonight's CB3/SLA committee meeting docket

So! The CB3/SLA licensing committee meets tonight... and there are two sessions — one at at 6:30 and 8:30...

Here's an updated look at a few of the items on tonight's agenda...

Applications within Saturated Areas

• Brownstone Lounge and Grill, 240 E 4th St (op) (aka 50 Ave B) (Affaire) (6:30pm)

Some nearby residents are concerned about the applicant looking to take over the Affaire space at 50 Avenue B. They met with Brownstone reps last Thursday.

As we understand it, the meeting did nothing to make the residents feel any better about the new venue. Among other concerns, the applicant apparently doesn't have any restaurant experience ... with a business plan that relies upon private party rentals of the basement space. In addition, residents feel as if the food is merely secondary to the space serving as a sports bar (plans call for 8 big-screen TVs) and party venue.

• JMDR 127 Ludlow LLC, 127 Ludlow St (op) (8:30pm)

This is the space held the past 17 years by the Motor City Bar... The application filed ahead of tonight's meeting doesn't provide much information about the new venture... other than the place will include a raw bar and a small DJ booth... the space would look like this, per CB3 documents...

The former Max Fish space is being fitted for an outpost of Sweet Chick, a southern-style restaurant ... BoweryBoogie has more on this here.

• Spiegel (Spiegel Inc), 26 1st Ave (wb) (6:30pm)

Apparently the newish corner deli here at East Second Street will make way for something called Spiegel, an American-Middle Eastern restaurant with hours from 8 a.m. to midnight.

As previously reported, the Artichokers are looking to take over El Sombrero here...

• Huertas (Molinero LLC), 107 1st Ave (wb) (8:30pm)

This is the space last held by L'asso EV. According to paperwork on file with CB3, Huertas will be a Spanish-themed restaurant with hours of 11:30 a.m. to midnight Monday-Thursday; to 1 a.m. on Friday-Saturday. The applicants previously owned a restaurant on Long Island.

The folks from the White Plains-based bar The Brazen Fox are opening a bar-restaurant in the former Friend House space at East 13th Street ... the space is still under construction and they are already seeking a license for a sidewalk cafe. Very Brazen!

She told Grub Street last year that "We're going to try to preserve as much of the history as possible."

Ah! Last week, contractors told EVG regular William Klayer that a "taco place" was opening at the former Good Guys, the burger-fries-salad-wraps-waffles-smoothie eatery that replaced a Subway on Second Avenue. Good Guys closed a few weeks ago.

Looks as if there's finally activity here ... most recently home to Sea Salt, the upscale fish eatery that closed in early 2008 after a seven-month stint... Brick Lane announced in April 2011 that they'd be taking over the space ...

New York Supreme Court upholds revocation of La Vie's liquor license

In late November, the State Liquor Authority revoked La Vie's liquor license on East First Street. (The license had apparently expired in February 2011, but La Vie had been operating under the NY State Administrative Procedures Act, aka SAPA).

In December, we were told that La Vie's lawyers "petitioned a court for a stay of the SLA's decision based on financial hardship while the Article 78 proceeding is pending."

Now it appears as if the ongoing battle between La Vie and its neighbors is over: Last Thursday, the 1st Department of the Appellate Division of the New York Supreme Court upheld the revocation of La Vie's liquor license. (You can find a PDF with the decision here. (Starts on page 88.)

The decision, in part, reads:

Evidence supporting the sustained charges includes numerous complaint reports, as well as the testimony of two police officers and an investigator employed by respondent, detailing incidents of ... disorderly activity, assaults, and violations of fire and safety regulations at petitioner’s premises in violation of sections 106(6), 114(6) and 118 of the Alcoholic Beverage Control Law and the Rules of the State Liquor Authority.

And.

The record shows that petitioner has a lengthy history of violations and there is no indication that petitioner took any steps to prevent the repeated incidents of disorderly conduct on or about its premises ...

We have considered petitioner’s remaining arguments, including that respondent improperly considered evidence outside the record of the proceedings when issuing its determination, and find them unavailing.

Neighbors have long complained that La Vie was operating as a club under the guise of a restaurant. According to residents speaking out at past CB3/SLA meetings, the dance music emanating from the club was loud and disruptive to their quality of life ... and they claim there was often chaos in the streets as patrons entered and exited.

Records on file with the State Liquor Authority show that the liquor license has expired.



There's no mention of an impending closure on La Vie's website or Facebook page. The last message is from Saturday, and it reads: "SATURDAYS AT LA VIE ARE LIKE NO OTHER!!! JOIN US FOR AN AMAZING TIME!!"

CB3 turns down The Living Room's bid to move to East 2nd Street

Catching up with Monday night's CB3/SLA committee meeting. One item of particular interest: The Living Room's proposal to take over the soon-to-be-former Klean & Kleaner laundromat on East Second Street. (Read the background on this here.)

Living Room co-founders Jennifer Gilson and Steve Rosenthal (pictured) were on-hand to make their case, though, ultimately, to no avail. The committee voted down the applicants. Let's have BoweryBoogie pick up the action:

As it stands, this stretch of Second Street was grandfathered into a general residence district, and doesn’t allow for any performances with cover charges. There was reportedly contact with the DOB to settle this issue, but the Living Room hadn’t heard any news as of last night. And they didn’t have the luxury of laying over the application another month due to landlord/lease constraints, so a vote had to transpire.

Cafe, tapas bar proposed for former Avenue B pet shop


Zee's Pet Shop closed up here on Avenue B just south of East 10th Street last spring. Now there's an applicant with designs on opening a 30-seat cafe-tapas bar with a retail component. The applicants will appear before the CB3/SLA committee this month.

Reps for Donostia (EV Cafe LLC), 155 Avenue B, filed an application on the CB3 website for a beer-wine license. Here's what we know from looking at the document online (PDF):

• The proposed hours are 10 a.m. to midnight.

• Listed food: "Spanish tapas, sandwiches, salads, meats, cheeses, etc."

• "The principal has worked as an employee a several fine dining establishments including Craft, db Bistro Moderne, Estiatorio Milos."

[Updated] Report: CB3 says yes to Golden Cadillac, denies the Asphalt Jungle

Golden Cadillac received the OK last night from the CB3/SLA committee to take over the former Boca Chica space on First Avenue at East First Street, Grub Street's Mary Reinholz reported this morning. (Read more about Golden Cadillac here.)

Meanwhile, regarding another big-ticket item, we heard from several attendees of last night's meeting about the contentious nature of the discussion over The Asphalt Jungle, the new cocktail lounge from the Dutch Kills team. They were applying to take over the former Mercadito Cantina space at 172 Avenue B.

Jean-Paul Buthier, owner of vintage shop Rue St Denis next door, was one of the people to speak out against the applicant. From his view, there are already enough bars on Avenue B ... "Maybe we need more AA meetings."

We'll let Grub Street pick up what reportedly happened next.

Seemingly stung by the Frenchman's comment, [Dutch Kills partner] Boccato replied that he and his partner Ian Present had roots in the East Village and were trying to create a safe and reputable establishment. "We're not carpetbaggers," he said, adding, "with all due respect, sir, your accent doesn't sound like a Native New Yorker." The barman's zinger elicited groans and protests from spectators, and even resulted in calls from committee chair Alexandra Militano for attendees to settle down.

On the April CB3/SLA docket: A billiards hall for Red Square; move for the Living Room; new partners for Boca Chica?

CB3 just released its schedule for April meetings... and there are some interesting applications on the SLA docket. We'll have more about the meeting, scheduled for April 8, later... for now, here are the more intriguing applicants:

This is the address for Boca Chica, which, as Serena Solomon at DNAinfo first reported on Feb. 26, closed while the remaining owner looked for new partners. Perhaps she has found some.

Well. This address is for the shops along Red Square between Avenue A and Avenue B ... and there's a big fat vacancy ever since Blockbuster closed last year. Interesting... seeing as Soho Billiards closed several blocks away late last year.

Back on the docket after withdrawing last month. The acoustic-music venue is hoping to take over the Klean & Klenaer laundromat, as we previously reported.

This is the address for the Nightingale Lounge. Anyone know what's going on here?

Is the Living Room moving to East Second Street?

The folks at CB3 just sent out the March SLA committee docket. We'll take a more thorough look at it later... Quickly, a few interesting items to note:

• To be Determined, 269 E Houston St (aka 188 Suffolk St) (op)

An unknown applicant is looking to take over the Local 269, the live music venue that never reopened after an apparent flood last September.

• The Living Room (ACP Project), 173 E 2nd St (op)

Not sure what to make of this at the moment. The Living Room, a favorite of the acoustic-music set over on Ludlow Street, will be leaving their home of 10 years at the end of April due to a huge rent hike.

The owners recently held a successful fundraising campaign to help move to an undisclosed new home. Perhaps this is it?

As we reported last September, Klean & Kleaner, the laundromat on East Second Street between Avenue A and Avenue B, was on the market for use as a bar or restaurant.

This is the former Mama's space... from the owner of Mama's Bar next door (no relation).

Oh, and yes — Soho House plans to expand and open a location on Ludlow Street. Good night.

Many of the applicants this time around are below Houston, so it's not really our fucking problem you can likely find more details on these establishments in the days/weeks ahead via BoweryBoogie and The Lo-Down.

Apartment 13 concept returns for Avenue C space

In October, a group headed by Paul Seres went before the CB3/SLA committee to discuss a new venture called Apartment 13 at 115 Avenue C between East Eighth Street and East Seventh Street. As we understand it, some neighbors opposed the plan, in part due to the presence of co-applicant Aleksandra Drozd of Ludlow Manor/DL (and The Delancey). The committee denied the plan, and the applicants withdrew before appearing before the full Community Board that month.

Apartment 13 returns to the docket for this Monday's CB3/SLA meeting. And, according to paperwork (PDF!) on file with CB3, this time around, only the name of Paul Seres, president of the New York Nightlife Association and a member of Community Board 4 (serving Chelsea), is listed as an applicant.

There are also more details. For instance, here is the dining concept:

All entrees at Apt 13 will be market driven and will be served in the same style as Korean barbeque. Every dish will be served with side dishes, appetizers, condiments, sauces, salads, and garnitures. Seasonally and locally driven. Family styled dinners. Meant to feel reminiscent of an intimate sit down dinner in our apartment. All dishes will change based on market availability. In following the theme and mission statement of apartment 13 we strive to not only support our local state Farms but also our neighborhood by featuring local artists and supporting local businesses.

The paperwork shows 36 tables seating 80 people... and one bar seating 12 people.

And the proposed hours are as follows:
Saturday — 11 a.m. - 4a.m.
Sunday — 11 a.m. - midnight
Monday — closed
Tuesday-Wednesday — 4 p.m. - midnight
Thursday-Friday — 4 p.m. - 2 a.m.

The committee meeting is Monday night at 6:30, JASA/Green Residence, 200 E. Fifth St. at the Bowery.

Suitor in line for Lucky Cheng's space

The November agenda is out for the CB3/SLA committee meeting... we'll highlight the docket in full a little later... (You can find it here for now.)

A few quick notes. The folks from the incoming Blue Ribbon Fried Chicken on East First Street are down for a beer-wine license.


Also, there's an unnamed suitor for the Lucky Cheng's space. (The cabaret is now open on Times Square.)

I asked Lucky Cheng's owner Hayne Suthon for an update on the space this morning, and she wasn't quite ready to divulge the To Be Determined. "Not sure. The attorneys are negotiating still — one main tenant with a back up," she said via email.

In an interview with Suthon on Oct. 12, Blackbook's Steve Lewis had this to sale about the evolution of Lucky Cheng's and what is next:

All was good until the neighborhood changed. The East Village/LES's conversion from hipster heaven to dormitories for slaves and students left them without their base. Bachelorette and birthday shindigs filled the Lucky Cheng’s room,and Hayne eyed the new Times Square. A year or two ago, I told everyone in town that her space was available and the best game in town. Now, operators are clamoring for it and deals are done... almost. Someone will make it nice for those who are now around. Money will be spent to pay for the rent, the renovation, and other things. The neighborhood can now support that. Whatever fabulous that comes in will set a bar... a tone for the area.

DL team hoping to take over the The Porch on Avenue C


Big things are in the works for the former Porch on Avenue C between Eighth Street and Seventh Street. People behind the LES soap opera the DL (formerly Ludlow Manor) at 95 Delancey are aiming to open a bar-restaurant concept, according to paperwork on file with CB3.

"Apartment 13, 115 Avenue C" is on the October CB3/SLA docket. Behind the new venture is Paul Seres, president of the New York Nightlife Association and a member of Community Board 4 (serving Chelsea). Ludlow Manor/DL (and The Delancey) partner Aleksandra Drozd is also listed as an applicant.

The application (PDF) lists a "restaurant-bar" opening here with 36 tables (and 80 seats) and 1 bar with 12 seats (plus a patio on the second floor). No opening time is listed, but closing time is midnight Sunday-Tuesday; 2 a.m. Wednesday-Thursday; 4 a.m. Friday and Saturday.

Food will be served during all business hours, and sample menu items include small plates of bone marrow gremolata ($14) and lobster brulee ($15).

How is the DL? Here is BoweryBoogie on it in July: "Scourge is probably the best word to describe the new party palace at 95 Delancey Street." A Yelper called the DL "one of the douchiest, skeeviest places I've ever visited."

There's not enough time to get into all all the history with the pre-DL incarnation, the Ludlow Manor, which included the involvement of Lady Gaga ex Luc Carl.
