The Marshal takes possession of the Subway (sandwich shop) on 1st Avenue

The Subway (sandwich shop) on First Avenue between Sixth Street and Seventh Street remains closed... this after the Marshal came calling late last week, putting the storefront in the legal possession of the landlord...



If this shutter remains permanent, then this marks the seventh Subway sandwich shop to close in the immediate area in the past five-plus years, joining the one on the BoweryEast 14th StreetFirst AvenueSecond AvenueThird Avenue ... and Fourth Avenue.

Subway fans still have the locations at 250 E. Houston St. and 223 Avenue B to choose from, among several others close by.

The Subway at 108 First Ave. opened in February 2012, taking over the space that previously housed Intervideo Electronics, that kinda weird and cool computer repair shop-plasma TV installers-DVD rental place...

A bad sign at Heart of India on 2nd Avenue



The Marshal came calling Monday at Heart of India, 79 Second Ave. between Fourth Street and Fifth Street.

The Indian restaurant remained closed yesterday. (As always in these cases, this doesn't necessarily mean the end for the business.)

Heart of India opened in April 2010.

The address was also once home to the Binibon, where career criminal Jack Henry Abbott stabbed the owner's son-in-law to death in 1981 following an argument about the restroom.

Weeks later, while eating with friends at the BiniBon, an all-night diner at 79 Second Avenue, Mr. Abbott became confused when Richard Adan, a part-time waiter, refused to let him use the bathroom. Within moments Mr. Abbott lured Mr. Adan outside, stabbed him to death and fled. At a Manhattan civil trial in 1990, the jury awarded Ricci Adan, Mr. Adan's widow, $7.57 million in damages, so Mr. Abbott will not receive a penny for the sales of ''In the Belly of the Beast'' or any other writings. At the trial, where he acted as his own lawyer, he told Mrs. Adan her husband's life was ''not worth a dime.'' Now 56, Mr. Abbott will become eligible for parole in June 2001.

The Marshal seizes Mamani Pizza on Avenue A



The Marshal came calling at Mamani Pizza at 151 Avenue A on Tuesday... the landlord is now in possession of the 99-cent sliceria between Ninth Street and 10th Street...



As always in these cases, this doesn't necessarily mean the end for the business. (The space had been on the market several years ago.)

The Marshal seized Mamani's former next-door neighbor at No. 151 last summer — TakeMeHome Rotisserie Chicken. (Brown paper is up in the windows there now. Looks like a new tenant is on the way in. Dessert maybe?)

No. 151 is owned by Raj 151 Avenue A LL and managed by Marolda Properties, per public records.

The Marshal seizes Palà on Allen Street



An EVG reader shares these photos... the landlord now has legal possession of Palà, the pizzeria at 198 Allen St. just south of Houston...



The Palà website is also no longer active.

Here's what New York had to say about the place a few years back:

The dough, which consists of nine organic flours, is allowed to rise naturally over three days, and the result is a marvelously light and crispy crust. Italian owner Gigio Palazzo says he set out to “change the game of pizza in New York.” And indeed he has. Delectable combos include the zucca, pumpkin purée layered with marbled pancetta. Palazzo’s savvy gamble on unlikely toppings pays off: Of the veggie options, the bufala cruda easily tops the list, heavy with misshapen hunks of mozzarella and roasted cherry tomatoes with splitting peels.

Palà opened in 2006 ... and underwent a major renovation in 2012.

Given the location and build-out with those roll-up garage doors, this promises to be a sought-after space...

The Marshal visits former Caffe Bene space on St. Mark's Place



As noted on Monday, the 17-month-old Caffe Bene outpost closed at 24 St. Mark's Place between Second Avenue and Third Avenue ... and yesterday, the Marshal paid a visit, taking legal possession of the space for the landlord...



Expect a new for rent sign soon enough...

Dahlia's-replacing salad and juice bar closes after 3 months on 2nd Avenue



After less than three months in business, 100% Healthy Blend (or maybe just Healthy Blend) has closed at Second Avenue and Fifth Street.

EVG regular Carol From East 5th Street, who shared the top photo, noted that workers were cleaning out the space yesterday.

There's also a notice from the Marshal, indicating that the property is now in possession of the landlord...





The quick-serve restaurant featured a sprawling menu that included create-your-own salads ... as well as juices, smoothies, empanadas, arepas and much more.

The corner spot was last home to Dahlia's, busted by the SLA after serving a reported 50 minors one night in January. The Mexican restaurant then closed in May.

Virgola is no more on 7th Street



The landlord has taken legal possession of the space that housed Virgola at 111 E. Seventh St. between Avenue A and First Avenue...



This was pretty quick (compared to how long the situation has dragged on over at 198 Avenue A with Empire Biscuit). The wine-oyster bar just opened last December.

As previously noted, there was ample oyster competition here, as the well-established Desnuda is across the street. And the wine bar Ruffian, with a broader menu, opened at 125 E. Seventh St., around the same time as Virgola.

Meanwhile, the proposed location for a Virgola outpost on Avenue B isn't happening.

The original Virgola opened three years ago on Greenwich Avenue. And Virgola has expanded nationwide with locations in Florida, Oklahoma and Wisconsin, according to the Virgola USA website.

So far Virgola has not responded to our query about the closure.

Lanza's is closed for now



The state's fluorescent SEIZED sticker (for "nonpayment of taxes") has arrived at Lanza's on First Avenue between 10th Street and 11th Street, as this photo via EVG reader Muzz shows.

There is also a notice from the State's Department of Taxation and Finance. There isn't any other information about the situation at the moment…

Remember that these seizures aren't always permanent, as we saw at Sahara East, among other businesses.

The old-world Italian restaurant first opened in 1904.

Red Koi Organic Sushi Lounge has closed on 1st Avenue



An EVG reader notes that in fairly quick succession, Red Koi Organic Sushi Lounge at 57 First Ave. closed... was served an eviction notice from the Marshal and put on the market.

We didn't know too much about this restaurant between Third Street and Fourth Street... it opened, as we recall, in late 2014...



As you will no doubt remember, the space was home, too briefly, to the Pudgie's-Nathan's-Arthur Treacher's action-packed combo during the glorious summer of 2012. That fryplex of fatty fun was sadly gone by the end of 2012. But we have our memories. And photos.

The listing for the space isn't online just yet. It was posted at $7,500 after Pudgie's died.

Tiny Empire's short run ends on Lafayette Street



Brooklyn-based juicery Tiny Empire opened a location down on Lafayette Street at Spring last August... by November, the DOH had shut down the location over some zoning issue with the downstairs bathroom, as BoweryBoogie noted.

By the end of January, a "temporarily closed" for "emergency maintenance/construction" signage arrived.

And Tiny Empire never reopened. On Wednesday, the Marshal paid a visit... and the landlord took legal possession of the space...

The Marshal seizes Tut on East 3rd Street



The landlord has taken legal possession of the hookah bar-restaurant Tut at 189 E. Third St. between Avenue A and Avenue B.

There isn't any information available about the closure at the moment. As always in these cases, this doesn't necessarily mean the end for the restaurant.

Since May 2014, the address has been home to Lumiere, Casablanca and now Tut.

The proprietors are on CB3's SLA docket for a license renewal under the "renewal with complaint" category.

The Marshal seizes the former Red & Gold Boil on St. Mark's Place



Back in early October, the rather unfortunately named Red & Gold Boil (sounds like a topic for a WebMD search) closed after 13 months in business at 30 St. Mark's Place between Second Avenue and Third Avenue.

The sign on the door from management made it seem as if the place may reopen with a new concept. (We look forward to serving you again, etc...)

The notice of eviction that recently arrived has now been joined by a note from the Marshal, announcing that the landlord has legal possession of the space...



The restaurant opened in August 2014 as the Red & Gold Crab Shack... somewhere along the line the boil replace the crab shack.

The Marshal seizes Nevada Smiths on 3rd Avenue

Several tipsters have told us that the Marshal has taken legal possession of Nevada Smiths at 100 Third Ave.

Of note: According to DNAinfo back in April, a New Jersey bank filed suit against Nevada Smiths after the bar failed to make the last four payments on a $150,000 loan.

The football/soccer mainstay opened in their new home between East 12th Street and East 13th Street in April 2013.

Le Marécage has apparently closed on 1st Avenue



The understated restaurant, which served an interesting mix of food from Haiti and the Ivory Coast, remained dark throughout the weekend here at 137 First Ave. just north of St. Mark's Place.

There's also a notice — dated Thursday — on the front window that the landlord has taken legal possession of the space…



Le Marécage, run by a husband-wife team (he was a longtime instructor at the French Culinary Institute), opened last October.

Not sure what happened here. The Times gave the place a glowing notice in its Hungry City column in March. Perhaps it couldn't compete with the other new, buzzier restaurants that opened nearby on First Avenue like Oiji or Noreetuh, which prompted reviews by Pete Wells at the Times.

10 Degrees Bistro now 'renegotiating terms with the landlord' on Avenue A



On Monday, the Marshal paid a visit to 10 Degrees Bistro at 131 Avenue A … noting that the landlord has taken legal possession of the restaurant between St. Mark's Place and East Ninth Street.

While that sign remains up on the closed-for-now bistro's front …



… there's a new sign explaining that 10 Degrees is closed for maintenance…



10 Degrees also took to Facebook yesterday to explain the situation…



So perhaps all this will be worked out soon enough… and they'll be one less vacant space along Avenue A.

Meanwhile, their sister property, 10 Degrees Bar, remains open around the corner on St. Mark's Place.

The Marshal seizes 10 Degrees Bistro on Avenue A



A reader sent along this photo from last night, showing that the landlord has taken legal possession of 10 Degrees Bistro at 131 Avenue A between St. Mark's Place and East Ninth Street.

There isn't any information available about the closure at the moment. This doesn't necessarily mean the end for the restaurant… but it's not a great sign either.

The proprietors of Ten Degrees Bar around the corner on St. Mark's took over operations of the Flea Market Cafe in March 2013 ... changing the name to 10 Degrees Bistro in December 2013.

Scarab Lounge space for rent on 1st Avenue



Scarab Lounge has closed at 139 First Ave. between St. Mark's Place and East Ninth Street … the for rent sign in the window was preceded by a Marshal's Legal Possession notice dated last Monday…



Don't know too much about the hookah bar … other than what we read on Yelp … and found during their brief time on Twitter…

La Lucha has closed on Avenue A



After nearly six years at 147 Avenue A, La Lucha is no longer in business here between East Ninth Street and East 10th Street.

Here's a tweet from yesterday from the taco shop/boutique… which mentions an upcoming move to Brooklyn…


There is also a Marshal's eviction notice on La Lucha's front door.

And there isn't any shortage of tacos these days in the neighborhood… Tacos Moreles opened up around the corner on East Ninth Street in August 2013 … and Empellón al Pastor opened last fall on Avenue A and St. Mark's Place…

Selling off the former Hop Devil Grill



In early April, the State of New York seized sister bars the Belgian Room and Hop Devil Grill on St. Mark's Place near Avenue A.

The bars will not be reopening. There's now a sign up on Hop Devil's front door, noting a Tax Compliance Agent's Sale on Thursday morning here at 125 St. Mark's Place…



There is not a sign up at the Belgian Room. (There is a flyer up next door at the former Ton-Up Cafe, the space that separates Hop Devil and the Belgian Room. Ton-Up has been on the market since the fall. Likely just some overzealous sign hanging on behalf of the State.)



Meanwhile, there still isn't any sign of life a storefront away at the Luca Bar. A Marshal's notice appeared on the door at 119 St. Mark's Place in late April.



Looking in, it appears that part of Luca's ceiling came down…



… and there's some mail too…



So that's four spaces among five storefronts here on the north side of St. Mark's primed for new businesses …

The Marshal seizes Luca Bar (again) on St. Mark's Place

Tough times for some bars/restaurants on the north side of St. Mark's Place between Avenue A and First Avenue.

On April 10, the state's fluorescent SEIZED sticker arrived at sister bars The Belgian Room and Hop Devil Grill. Both establishments have yet to reopen.

And now there's a Marshal's notice (photo above) on the door at Luca Bar, 119 St. Mark's Place.

And this isn't the first time that the Luca Bar has had landlord/tax-related issues. There was an eviction notice posted here back in November 2013. The bar reopened several days later. The state also seized the property in June 2011.
