Cleanup planned for E-bike hub on 11th Street following spike in complaints

Signage recently went along 11th Street between Avenue A and First Avenue, announcing a scheduled cleanup of the heavily trafficked e-bike, moped and bicycle area. 

The effort — slated to begin today — is a joint initiative by the 9th Precinct and the Department of Sanitation, prompted by a surge in community complaints. 

The block is a popular spot for e-bike delivery workers to gather as they wait to fulfill deliveries, in part given the proximity of the under-renovation Madina Masjid Islamic Council of America, one of the city's most prominent mosques, founded in 1976. 

The signs, posted in English, Spanish, Arabic, French, and Wolof, notify residents and delivery workers that any bikes not moved by the cleanup date (the deadline was yesterday) will be removed and impounded.
According to residents and local officials, complaints about congestion, noise, and sanitation issues tied to the unofficial parking and staging area have intensified in recent months. The issue has become a recurring topic at neighborhood council meetings at the 9th Precinct. 

Police say this is part of a broader effort to address quality-of-life issues while balancing the needs of workers and residents. 

While some in the community have voiced frustration, many delivery workers — aka deliveristas — say they've taken steps to keep the area clean. 

Several riders on the block pointed out trash bags and brooms they've been using to manage the space themselves.
They also spoke to me, stating they need security here because they say their methods of transportation for making a living are often stolen. Despite using GPS and tracking devices, they claim police are not willing to help them track down their bikes.
In past years, the Madina Masjid mosque has drawn criticism from local residents and business owners due to "cabbies filling metered spaces and parking in front of fire hydrants, in truck loading zones and in bus lanes" to attend prayer services, according to published reports

Parking for prayer services has been an issue since the religious institution opened, per DNAinfo in 2013. What was once a battle over car congestion has shifted gears — now, it's all about the bikes for some residents.

Late yesterday afternoon, EVG reader Choresh Wald shared this photo, noting that the city added a sidewalk extension on the SE corner of First Avenue and 11th Street. The perpetual food truck here even relocated to the SW corner of First Avenue and 11th Street...
... but it had returned within an hour...
We haven't received any updates about an extension here... we'll see if we can get clarification on what's happening.

Vehicles are currently parked where the bike lanes were (despite notices not to park there) on Second Avenue. The bike lanes will return with the resurfacing...

What's the 311? How East Village residents can effectively file complaints

Judging from the extensive volume of comments on EV Grieve posts, there are plenty of complaints about problems in the neighborhood. The list is long, and includes rats, loud bars and clubs, restaurants, and curbside dining structures, nightlife in general, unlicensed smoke shops, drivers parking in bike lanes, cyclists riding on the sidewalk, and emotionally disturbed people.

But what can one do to get solutions to neighborhood problems? 

I sat down with Susan Stetzer, the local Community Board 3 district manager, to find out what can be done when someone is facing a quality-of-life issue.
How does one file an effective 311 complaint? Is it best to do it online through the portal or by phone? 

The most important thing is to file the complaint [link here]. Depending on the time and the complaint, you may have to wait a long time and prefer to use the app. Otherwise, I suggest calling. There may be questions from the operator that will make the complaint complete. I always ask that the complaint be read back to me to ensure all the details are correct. 

Some 311 complaints are immediately processed and responded to. Two of these are the rat portal at nyc.gov (the health department pest division pays close attention to rat complaints and will inspect), the other is "homeless person in need of services." Homeless Outreach will respond — usually within an hour. 

What types of complaints can one file, and when should one not use the 311 system? 

311 is for NYC complaints. Therefore, it won't work for state or federal complaints. If a bar is violating stipulations — such as keeping windows open past 10 p.m. — this is not a violation of city law. However, it violates the bar's state license, so these types of State Liquor Authority complaints should be made to the SLA on the SLA website.

We have recently learned of people making "loitering" complaints, but there is no law against loitering. Doorways, entrances, and exits cannot be blocked, but you should be specific if that is the case. Also, Community Board 3 has a complaint form on the website

It is very helpful to use this form as it guides you through important information. Sometimes, we get a complaint by email or through the form, and the person does not include a contact email and states they have not called 311 to report. Not having contact information makes it really hard to resolve the problem, even more so when 311 has not been contacted. 

Is there a "complaint season?"

Summer is the season for rats and bar noise. Winter, of course, for heat complaints. 

We hear from people time and time again that their complaints are not addressed. For example, The 311 system lookup indicated that the ticket was closed out and no action was taken, that the police responded and didn’t find an issue, or that they watched from their window or door as the police responded by going to the address and then leaving without taking any steps to fix the issue. What can you advise about that?

These flaws do exist. But to answer by issue: Having a ticket closed does not necessarily mean that there is not an action or response. It may be that it was reported to the responsible agency. For instance, the ticket is closed when DOT refers a complaint to another agency or Con Ed. But another agency is now working on the issue. This is where the Community Board can be helpful — we can follow up for you. 

Regarding police finding no issue—that is often the case. It may be that they did not respond for a long time, and the condition was gone. But, if there is a problem situation and there are many calls, there will also be responses that police respond and take action. I'm often surprised by how many times this happens. Also, 311 calls create a record. The Community Board may be working with the precinct and reporting complaints about a location, and the precinct may respond with, "There are no 311 complaints for this location."

If you have called, regardless of the outcome, you have created a record of complaint. We recently had a meeting with the SLA and were told that people should make 311 complaints and report a number of 311 complaints when reporting a problem to the SLA. They specifically said to do this even without a police finding. 

Regarding police closing a complaint when you know there has not been a response or other similar issues, this can occasionally happen, and I have personally observed it. I always report this to the commanding officer or another officer I work with. If this happens, our office will work with you and the precinct.

When is it time to escalate a complaint? Should one also call the precinct or community affairs?

We are fortunate that we have very excellent Community Affairs officers. They also generally remain in their positions for years and gain knowledge of our community and issues. Police should be called for police issues. I have observed at precinct meetings that sometimes people expect the police to take care of all problems — rats, homelessness, and building violations. Contact police for police issues. 

We also work very closely with elected officials’ offices, and different offices will take the lead on different issues. Our state elected officials for state issues like rent regulation and state laws, and our councilmember with some agency issues (such as DOB) where they are more likely and able to get a responsive action. 

Also, all Community Boards are mandated by the City charter to hold a district service cabinet meeting every month. This is a multi-agency meeting to find solutions to multiagency issues and is one of our best tools for finding solutions.
How can residents get their issues addressed, and what type of mediation – if any – is available? 

Mediation is a wonderful tool for the right situations. I remember directing parties to mediation for a community garden dispute. The former director of nightlife devised mediation for bar complaints as a way to reduce the number of violations of nightlife businesses. It has worked for this purpose—fewer violations have been issued. 

Here is an email I received from an officer: "The city has moved away from wanting to cite bars/ establishments for infractions as suchNYC CURE is a non-enforcement unit that wants to help. I also recommend NYC Mend, which will arrange a mediation between residents and establishment owners with professional mediators."

The problem with MEND (mediating establishment and neighborhood disputes) is that most nightlife businesses have stipulations requested by the community and Community Board, and the SLA puts the license on the license as a condition of operation. Mediation does not deal with any legal issues and does not inquire if there are stipulations and if they are being violated.

Therefore, the very method devised by the SLA and community boards to address community issues and support businesses is ignored. I have brought this up with MEND many times, but they do not wish to address this fault. There is also no way to enforce the resolution. I have been involved in two mediations with residents and businesses. Both times, there was agreement on resolving the issue, but there was no follow-up to the agreement. Also, the mediations are secret. 

Many businesses we work with want to be good neighbors and contributing members of the community. We can often resolve problems with information and a phone call. But we all focus on the problems we can’t resolve so easily. It is important to acknowledge our good neighbors. 

Are there any tips or resources you can recommend for residents who feel beaten down by the war of attrition in fighting noise (or other issue) from a restaurant, club, neighbor, or business? 

The only tip I can give is — don’t give up. There is strength in numbers, working with agencies, elected officials and Community Boards. Things change. Lily Fan, the relatively new SLA chair, works with the community and is very responsive. 

Not all nightlife issues are state issues, but for the ones that are, the SLA is very firm in their enforcement. Community Boards may need to do outreach on how to work with the SLA when the final Dining Out guidelines are published by the SLA.

Nearly 3 years later, city is finishing the Avenue C bike lanes

DOT crews were out yesterday working on bike lanes on both sides of Avenue C between Eighth Street and Ninth Street.
This work comes nearly three years after the city first marked Avenue C for the new bike lanes. However, with the pandemic-era curbside dining structures still in place outside several establishments between Sixth Street and Ninth Street, cyclists were forced to enter into traffic for several blocks before the marked lanes picked up again in both directions at Ninth Street. 

However, earlier this spring, the remaining streetside structures were removed, and there is now a protected bike lane between Sixth and Ninth Street on the east side of the avenue. Here's a look at the buffer zones that will protect cyclists from cars and trucks ...
On the west side, despite the freshly painted bike lane, drivers were observed parking between Eighth Street and Ninth Street, posing a potential hazard for cyclists...
There are also a few mixing spots on Avenue C where the bike lane passes through a bus stop, like just below Eighth Street outside the Associated...
Several years in the planning stages, the DOT added the protected north/south bike lanes on Avenue C and East Houston Street to help offset the closure of the East River Park greenway.

Reader report: No motor vehicles in the bike lane

EVG reader Garrett Rosso shared this photo yesterday from First Avenue near 13th Street, where someone mounted a "No Motor Vehicles" sign facing this northbound bike lane.

Per Garrett: "Citizenry resort to posting their own signs since electeds leave transportation alternatives largely lawless & unregulated." 

We spotted another sign on First Avenue just past First Street. There are likely more. (Let us know if you spot any elsewhere.) 

There is confusion between legal e-bikes (electrified devices with pedals) and mopeds, many of which are illegal and need to be registered with the Department of Motor Vehicles and issued license plates. 

The NYPD also doesn't seem to know the difference, seemingly demonizing, as Streetsblog put it, all electric, two-wheeled devices (save for Citi Bikes). The NYPD later started cracking down on illegal sales before the actual sale.

Streetsblog put out a handy field guide last year (which you can find here). 

As they put it:
"Certainly, New Yorkers are confused about all the new motorized devices that are filling our roadways (and, infuriatingly, our bike lanes), which have become a Wild West of chaotic interactions."

And...

All the two-wheeled motorized devices on the market today are potentially far safer to vulnerable road users than the four-wheeled, 3,000- to 5,000-pound conveyances they seek to supplant. But it doesn't feel that way right now because users of illegal mopeds are often speeding through bike lanes, surprising pedestrians with their speed. Of course moped riders are choosing the bike lane — it’s the only place where they feel safe from the true behemoth on the roads: cars and trucks.

E-scooters — defined by the city as having handlebars and a floorboard or seat, and powered by electric and/or a person — are allowed in NYC. 


• You must not operate an e-scooter in excess of 15 MPH. 
• E-scooters may be ridden in bike lanes and on streets with speed limits no greater than 30 MPH. 
• Do not ride e-scooters on sidewalks.
Back to the signage... yes — the mopeds and various motorcycles need to get out of the bike lanes.

Milling and paving continues along Houston ahead of bike lane upgrade

City workers have resurfaced eastbound lanes on Houston Street from Second Avenue to Suffolk Street...
As first reported last Mondaythe DOT is upgrading the existing bike lanes on Houston Street between Second Avenue and the FDR. Crews still have the roadway from Suffolk Street to the FDR left to do ...
Here's a recap of what is happening with the improvements in the days/weeks ahead: 
  • Resurfacing of Houston between Second Avenue and the FDR
  • Installing parking-protected bike lanes on Houston between Forsyth and the FDR 
  • Installing delineator-protected and curbside bike lanes on Houston between Second Avenue and Forsyth .. and between Ludlow and Essex

This Houston Street work comes four months after the $1.45-billion East Side Coastal Resiliency (ESCR) project shut down bike access along the East River starting at Montgomery Street. 
The DOT pointed out the work in a tweet from late last week... Up next: Milling, then paving the westbound lanes along the same Houston Street corridor...
Based on the posted notices between Avenue A and Avenue C, it looks as if work will start here tomorrow (Tuesday) evening ...

Bike-lane upgrade underway on Houston

Work continues along East Houston Street as the DOT is upgrading the existing bike lanes on Houston Street between Second Avenue and the FDR...
Workers last week milled the eastbound lanes of Houston between Second Avenue and Avenue A. The crew will continue on toward the FDR starting this evening, per the posted warnings...

9th Precinct now issuing tickets to anyone parking in Neighborhood Loading Zones

Here's a warning for anyone who continues to park long-term in Neighborhood Loading Zones. 

The NYPD is now writing tickets for anyone who uses the Department of Transportation's recently added Neighborhood Loading Zones around the East Village for anything other than quick pick-ups and drop-offs.
From 8 a.m. to 6 p.m. Monday through Friday, these spaces are reserved for activities such as: 
• Package deliveries by commercial vehicles 
• Taxi and car service pick-up and drop-off
• Active loading and unloading of personal vehicles 

However, given the number of people parking long-term in these spots during the week, the 9th Precinct and the Manhattan Traffic Enforcement Unit recently started enforcing violations to noncommercial plate vehicles in these spaces. 

"We'd rather educate and inform people than write summonses," Officer Eugene Adeleye at the 9th Precinct told EVG correspondent Stacie Joy. "We've been getting complaints from residents and we will be actively writing summons to violators." 

Previously, the NYPD would issue tickets in these spots, but it was mainly at the discretion of the officer/traffic agents. 

As for commercial vehicles that continue to double-park on the street and block a bike lane, Adeleye said: "The trucks loading and unloading are not supposed to interfere with bike lanes, and if they do that is a violation, and they may get tickets themselves." 

Adeleye also said that he was sympathetic to residents upset at the loss of parking spots in recent years, from outdoor dining structures to Citi Bike docking stations.

"We are only doing this based on complaints we've received with no intention of giving anyone a hard time — that's why we are trying to educate people as much as we can," he said. "I feel like if people are aware, then they might be able to avoid getting an unnecessary summons."

That's the answer to the (rhetorical) question posed in a headline on Saturday: Have we seen the last of the sinkhole on 1st Avenue at 5th Street? 

Despite the arrival of a freshly painted crosswalk and bike lanes on Fifth Street at First Avenue, a crew is back on the scene today doing more work at the intersection...

Have we seen the last of the sinkhole on 1st Avenue at 5th Street?

Updated 3/14: We're back!

After multiple attempts at digging and patching, patching and digging, it appears the intersection of First Avenue at Fifth Street is officially sinkhole free.

Workers recently painted the crosswalk and bike lanes here again — a good sign that they likely won't have to do this again until the summer.

A Neighborhood Loading Zone for this block of 9th Street

On Saturday, the Department of Transportation (DOT) added a Neighborhood Loading Zone on the north side of Ninth Street between First Avenue and Second Avenue...
From 8 a.m. to 6 p.m. Monday through Friday, these spaces are reserved for activities such as:

• Package deliveries by commercial vehicles 
• Taxi and car service pick-up and drop-off 
• Active loading and unloading of personal vehicles
The program "aims to reduce double parking on narrow residential streets by providing space at the curb," per the DOT website

As Streetsblog recently reported, the DOT "is now required by law to install at least 500 loading zones annually to mitigate the boom in deliveries." 

Last summer, the city added loading zones on several sidestreets as part of the new Avenue C bike lanes

Here are the proposed locations for new Citi Bike docking stations in the East Village

Admittedly overdue on a follow-up on this story... last month, DOT reps provided Community Board 3's Transportation, Public Safety, & Environment Committee an update about Citi Bike's expansion in the East Village and Lower East Side.

According to the presentation, "demand shows 1,804 docks [are] still needed in CB3." For now, though, the proposal calls for an installation of 683 docks ... with more capacity coming by extending existing stations.

The maps below (click on the images for more detail) show where the infill is slated. The green dots are extensions at existing stations (the only EV extension on the map is at 13th Street and Avenue A) ... while the red circles denote new stations (11 in total, with an "equipment swap" on 10th Street between A and B) ... 
A study by the DOT and Citi Bike found that the ride-sharing service was falling behind in keeping up with the cycling demand of New Yorkers.

As Streetsblog reported on Nov. 2:
Citi Bike announced that it needs the DOT to provide it with sites for an immediate Lyft-funded infusion of docks and bikes because the system is under "added stress [in] its original service area, which serves a disproportionate number of the total rides."

In other words, too many people are either showing up at docks that are empty or trying to return bikes to full racks. Even as it is breaking its own records, Citi Bike estimates that it lost 4 million rides in 2021 because customers are getting frustrated. The company cited the ridership increases as well as "unpredictable commuting patterns as a result of the pandemic.

"An unbalanced system results in riders finding empty or full docks during periods of peak demand," a problem that cannot be totally mitigated through rebalancing or Bike Angels, the company said.
Stories of Citi Bikers wandering around for 30 minutes looking for an open dock — or just a bike — in the evening have become common in recent months. (East Village resident and cycling advocate Sophie Maerowitz wrote an op-ed on the topic for amNY on Nov. 15.) 

The Times checked in with an article on the topic as well the other day, reporting that through Nov. 17, Citi Bike had recorded 25.2 million rides in 2021, 4 million more than in all of 2019. (Citi Bike debuted here in 2013.) 

But!
[A]s the city has sought to accommodate the surge in both bike-share use and overall cycling by adding hundreds of miles of bike lanes, it has provoked a backlash from drivers and some elected officials who complain that parking and driving are now more difficult.
No word on when the infill might happen within the confines of Community Board 3. The DOT and Citi Bike said they plan to add 8,000 more docks and 4,000 more bikes by the end of 2022, mostly in Manhattan.

Neighborhood Loading Zones, bike lane outlines arrive along Avenue C

The loading zones for commercial vehicles, residents and taxis and car services are part of the DOT's plan for the Avenue C bike lanes. (Other loading zones are expected on side streets along this corridor.)

Meanwhile, last week, the DOT continued marking the roadway with the new bike-lane designations...
Still a work in progress... as cars and commercial trucks continued to park in the freshly marked bike lanes...
... and dueling bike lanes were spotted north of 10th Street...
As reported last fall, the DOT is adding the protected north/south bike lanes on Avenue C and East Houston Street to help offset the upcoming closure of the East River Park greenway.

Planned improvements for cyclists, pedestrians and motorists along C include: 

• Curbside bike lanes between Houston and Fourth Street 
• Parking-protected, bollard-protected and curbside bike lanes between Fourth Street and 18th Street 
• Updated parking regulations to provide truck loading zones 
• Neighborhood loading zones on select side streets 
• Painted pedestrian islands between 11th Street and 15th Street 
• New left-turn bays at 10th Street and 14th Street
