March 28



EVG reader Andrew spotted this beaut this morning on East Third Street between Avenue A and Avenue B...

While we mentioned the lack of any time stamp to prove that this is from today and not, say, Dec. 26 (is it? Please say no!)... we are allowing this one to stand, so to speak.

You see, under Evidence Rule 901, photographs are typically admitted as demonstrative evidence to illustrate discarded holiday/Christmas trees. When used purely as demonstrative evidence, legal issues regarding authentication are somewhat relaxed so long as a competent witness can testify that the photograph fairly and accurately depicts the tree about which he or she is submitting.

My name is Bryce and I live at 160 E 3rd. My dog (Mocha) and I saw this "tree" this morning. While she peed on it, I thought about taking a picture, but didn't have anything with the date for proof.

If the two-person authentication rule works for the release of nuclear weapons, then perhaps it could also work for the very serious task of authenticating christmas tree disposal dates?

While not as recent (I snapped this on Tuesday, March 25 before it was taken away by DSNY), this majestic beauty was in remarkably good shape considering it only missed out on Christmas by 3 months.

I smell the stench of graft, corruption, and conspiracy. Clearly Evidence Rule 901 should be be called the Kickback Loophole. Where did you draft this rule? In the Port Authority Building in Fort Lee? For shame, for shame. Rules are Rules. Propoer procedures should be observed. I'll never trust the pocket-lining money-grubbers at ICTTSS again.
